Terms of Service

1. About easybits

easybits GmbH, Choriner Str. 83, 10119 Berlin, Germany ("easybits", "we", "us") operates the data extraction service available at https://extractor.easybits.tech (the "Service").

By creating an account or using the Service, you ("you", "your", "User") agree to these Terms of Service ("Terms"). If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

These Terms apply to all users of the Service, including users of the free Sandbox plan. By using the Service, you also agree to our Privacy Policy, available at https://easybits.tech/pages/legal/en/privacy-policy/ which is incorporated into these Terms by reference.

2. The Service

easybits provides a self-service document data extraction platform. You can upload documents, define extraction schemas, and receive structured data output via the user interface or API.

We may update, modify, or improve the Service at any time. We will not materially reduce the core functionality of a paid plan without reasonable notice.

The Service is provided on a self-service basis. We do not guarantee that extracted data will be accurate, complete, or suitable for any specific purpose.

3. Accounts

You must create an account to use the Service. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You must provide accurate information when creating your account. If you are registering as a business, please use your business name and contact details.

You must be at least 18 years old to use the Service.

4. Plans, Pricing & Payment

We offer the following plans. All prices are exclusive of applicable VAT.

A "request" is one file or document processed through the Service. Unused requests expire at the end of each billing month and do not carry over.

Paid plans are billed monthly in advance via the payment methods available at checkout. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring monthly basis.

If you exceed your monthly request quota, we may block further processing, charge for additional requests, or upgrade you to the next plan.

If payment fails, we may suspend access to the Service until the outstanding amount is settled.

Online Dispute Resolution (B2C only): The European Commission provides a platform for online dispute resolution (ODR) which is available at https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we are willing to do so in individual cases. 5. Free Sandbox Plan

The Sandbox plan is free and requires no credit card. It is intended for prototyping and testing only. We reserve the right to modify or discontinue the Sandbox plan at any time with reasonable notice.

Commercial use of the Sandbox plan at scale is not permitted.

6. Acceptable Use

You agree to use the Service in compliance with applicable law and these Terms. You must not:

– upload content you do not have the right to process;

– attempt to reverse engineer, copy, or resell the Service without authorisation;

– use the Service in a way that could damage, overload, or impair our infrastructure;

– use the Service to process illegal content or to violate the rights of third parties.

You may use the Service on behalf of your own clients ("proxy use"), provided you take full responsibility for their compliance with these Terms.

7. Your Data

You retain ownership of all documents and data you upload to the Service ("Your Data"). We process Your Data solely to provide the Service to you.

We implement appropriate technical and organisational measures to protect Your Data.

If your use of the Service involves the processing of personal data (e.g. uploading documents containing names, contact details, or other personal information), a Data Processing Agreement (DPA) under Art. 28 GDPR is legally required before you begin processing. For B2B customers, this is mandatory, not optional. Please contact us at support@easybits.tech to obtain and sign our standard DPA. You must not process personal data through the Service until a DPA is in place.

When you delete your account or your subscription ends, we will permanently delete Your Data within 14 days, unless we are required to retain it by law. Until your account is closed, you can export Your Data in JSON format via the Service.

8. Intellectual Property

All rights in the Service, including the software, algorithms, models, and documentation, belong to easybits or its licensors. These Terms do not transfer any intellectual property rights to you.

You grant us a limited licence to process Your Data solely to provide the Service.

9. Availability & Support

We aim to keep the Service highly available but do not guarantee any specific uptime.

We will give at least 30 days' advance notice of any material changes to our API or core functionality ("breaking changes").

Support is available via email or in-app chat. We aim to respond within 48 hours on business days (Monday–Friday, 09:00–17:00 CET, excluding Berlin public holidays).

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms affects your statutory rights as a consumer under applicable law, including rights under §§ 327–327s BGB (Digital Content and Digital Services) for B2C users. To the extent the Service constitutes a digital service under applicable consumer law, your statutory conformity rights remain unaffected by these disclaimers.

We are not responsible for the accuracy or completeness of data extracted by the Service. You are responsible for validating outputs before relying on them.

11. Limitation of Liability

To the fullest extent permitted by law, easybits will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits or data, arising from your use of the Service.

Our total liability to you for any claim arising under these Terms will not exceed the fees you paid to us in the six (6) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for gross negligence, wilful misconduct, injury to life, body or health, or any liability that cannot be excluded under applicable law, including mandatory consumer protection provisions under German law (§§ 305–310 BGB). For B2C users, your statutory warranty and liability rights under German law remain fully unaffected.

12. Term & Termination

These Terms apply from the date you create your account and continue until your account is closed.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing month.

We may suspend or terminate your account if you breach these Terms, fail to pay, or if we are required to do so by law. We will give reasonable notice where possible.

On termination, your access to the Service ends. Your Data will be deleted within 14 days.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via an in-app notice at least 30 days before the changes take effect.

Your continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your account before they take effect.

14. Governing Law

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for any disputes is Berlin, Germany, to the extent permitted by law.

15. Right of Withdrawal (B2C Customers Only)

If you are a consumer (i.e. a natural person acting outside your trade, business, or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date of conclusion of the contract (i.e. when you subscribe to a paid plan). To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (e.g. a letter sent by post or email) before the withdrawal period expires:

You may use the model withdrawal form below, but it is not obligatory.

Model Withdrawal Form: To easybits GmbH, Choriner Str. 83, 10119 Berlin, support@easybits.tech — I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service: [plan name], ordered on [date], name of consumer(s), address of consumer(s), date. (*) Delete as applicable.

Early commencement and loss of withdrawal right: If you expressly request that we begin providing the Service before the end of the withdrawal period, and the Service is fully performed, you lose your right of withdrawal. By subscribing and starting to use the Service immediately, you expressly consent to early commencement and acknowledge that your right of withdrawal expires upon full performance.

16. Payment Processing & Subprocessors

We use Stripe, Inc. (and its affiliate Stripe Payments Europe, Limited) as our payment processor. When you subscribe to a paid plan, your payment data (including card details and billing address) is processed by Stripe in accordance with their privacy policy (stripe.com/privacy). easybits does not store your full card details.

Stripe is a registered data subprocessor under our GDPR framework. By subscribing, you consent to the transfer of payment-related personal data to Stripe for the purpose of processing your subscription.
